1.2 It forms part of the Nomming Terms of Service.
2. Educational and Informational Purpose
2.1 Nomming is intended for general meal logging, education and informational use.
2.2 Information provided through Nomming is not a substitute for:
- a medical assessment;
- diagnosis or treatment;
- advice from a doctor, accredited practising dietitian or other qualified professional;
- a verified food label; or
- laboratory or clinical testing.
3. Not a Medical Device
3.1 Nomming is not a medical device.
3.2 Nomming does not diagnose, treat, cure or prevent any disease, injury, disorder or medical condition.
3.3 The Service is not designed for clinical decision-making, emergency use or the management of a condition requiring medical supervision.
4. No Medical or Professional Advice
4.1 The Service does not provide medical, nutritional, dietary, psychological or other professional healthcare advice.
4.2 AI Output does not create a practitioner-patient relationship.
4.3 Do not disregard, delay or replace professional advice because of information provided through Nomming.
4.4 For medical advice, diagnosis or treatment, consult a qualified healthcare professional.
4.5 In an emergency or where you believe there is an immediate risk to health or safety, contact local emergency services.
5. Artificial Intelligence Limitations
5.1 Nomming uses artificial intelligence and automated processing to analyse meal photographs, voice entries, transcripts and text descriptions.
5.2 AI Output is probabilistic. It may be incorrect, incomplete, inconsistent, outdated or unsuitable for your circumstances.
5.3 The Service may:
- identify the wrong food or restaurant;
- omit ingredients;
- misunderstand speech or text;
- incorrectly estimate portion size;
- fail to identify cooking oils, sauces, fillings or hidden ingredients;
- apply an unsuitable reference food; or
- generate different results for the same meal.
5.4 Confidence scores, alternatives and descriptive labels are not guarantees of accuracy.
5.5 AI Output may change as models, prompts, nutrition references and Service functionality are updated.
6. Nutrition Estimate Limitations
6.1 Calories, protein, carbohydrates, fat, fibre and other nutrition values are estimates.
6.2 Actual values may differ materially due to:
- portion size;
- recipe variation;
- ingredient brands;
- cooking method;
- absorbed oil;
- sauces, dressings and condiments;
- restaurant preparation;
- substitutions;
- image quality and angle; and
- incomplete information supplied by the user.
6.3 Estimates must not be treated as exact measurements, certified nutrition information or a replacement for product labels.
6.4 Where accuracy is important, verify ingredients and nutrition information from the manufacturer, restaurant, recipe source or an appropriately qualified professional.
7. Food Allergies and Intolerances
7.1 Do not use Nomming to determine whether a meal is free from an allergen or suitable for a food intolerance.
7.2 The Service cannot reliably detect:
- hidden ingredients;
- trace allergens;
- cross-contamination;
- substitutions;
- preparation surfaces; or
- ingredients not visible in an image.
7.3 Never rely on AI Output to decide whether food is safe to consume.
7.4 Confirm allergen information directly with the manufacturer, restaurant or food preparer and follow advice provided by a qualified healthcare professional.
7.5 If you experience or suspect a serious allergic reaction, seek emergency assistance immediately.
8. Health Conditions
8.1 The Service should not be used as the sole basis for managing:
- diabetes or blood-glucose levels;
- food allergies or intolerances;
- eating disorders;
- pregnancy or breastfeeding;
- kidney, liver, cardiovascular or metabolic conditions;
- nutrient deficiencies;
- medication interactions;
- medically prescribed diets; or
- any condition requiring clinical monitoring.
8.2 Users with a health condition should consult an appropriately qualified professional before making material dietary changes.
9. Eating Disorders and Unsafe Dieting
9.1 Calorie and nutrition tracking may be unsuitable for some users, including people experiencing or recovering from an eating disorder.
9.2 Stop using tracking features and seek professional support if the Service contributes to distress, compulsive behaviour, excessive restriction, purging, anxiety or an unhealthy preoccupation with food or body weight.
9.3 Group challenges must not be treated as medical programs or used to pressure participants into unsafe behaviour.
10. Children and Young People
10.1 Nutrition needs vary significantly during growth and development.
10.2 A child or young person should not use AI-generated calorie or nutrient estimates to commence a restrictive diet without appropriate parental involvement and advice from a qualified healthcare professional.
10.3 The Service is not intended for children under 13.
11. User Responsibility
11.1 You are responsible for:
- reviewing and correcting meal records;
- checking food labels and ingredient information;
- obtaining professional advice where appropriate;
- determining whether information is suitable for your circumstances; and
- making your own dietary and health decisions.
11.2 User edits improve the accuracy of an individual record but do not convert it into professional or laboratory-verified information.
12. Third-Party Information
12.1 Some information may be obtained or derived from third-party databases, service providers, restaurants, manufacturers or other external sources.
12.2 Third-party information may be incomplete, outdated or changed without notice.
12.3 References to a food, restaurant, brand or product do not constitute endorsement or confirmation of its ingredients, safety or nutritional content.
13. No Guaranteed Outcome
13.1 Nomming does not guarantee:
- weight loss, weight gain or weight maintenance;
- improved fitness or health;
- achievement of a nutrition target;
- detection of a particular food or ingredient;
- accuracy of calorie or nutrient estimates; or
- suitability of information for a particular user.
13.2 Individual outcomes depend on factors outside the Service, including health status, metabolism, activity, adherence, medication and professional care.
14. Liability and Consumer Rights
14.1 To the maximum extent permitted by law, Emma Infotech Pty Ltd is not responsible for loss resulting from reliance on AI Output contrary to this Disclaimer.
14.2 Nothing in this Disclaimer excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.
14.3 Any limitation of liability is subject to the Nomming Terms of Service and applies only to the extent lawful, fair and reasonable.
